These Terms of Service ("Terms") govern your access to and use of our website (bdwellnessdna.com) and the purchase and use of our DNA testing, wellness assessments, and mobile phlebotomy services (collectively, the "Services"). By booking an appointment, purchasing a test, or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services. Black Diamond Wellness & DNA Services provides various health and wellness solutions, including but not limited to: ●DNA Testing: Paternity (Legal and Non-Legal), Maternity, Gender Reveal, and Sensitivity testing. ●Wellness Assessments: Metabolic Wellness and Nutrition DNA testing. ●Screening Services: Rapid Drug Testing (including point-of-collection rapid screening). ●Mobile Phlebotomy: Professional specimen collection services (including blood draws and/or buccal swabs, as applicable) performed at a location of your choice, subject to availability and safety considerations. Our Services may involve coordinating with third-party laboratories or vendors for analysis and reporting. We provide collection, coordination, and reporting support; laboratory analysis is performed by the applicable laboratory pursuant to its procedures and quality standards. The information and services provided by Black Diamond Wellness & DNA Services are for informational, educational, and wellness purposes only. We do not provide medical advice, diagnosis, or treatment, and nothing we provide is a substitute for professional medical care. ●Not a healthcare provider. We are not acting as your physician or healthcare provider, and we do not establish a doctor-patient relationship. ●Wellness services are informational. Metabolic wellness assessments, sensitivity testing, nutrition DNA insights, and any related reports or recommendations are intended to support general wellness and lifestyle decision-making only and may not be appropriate for everyone. ●No guarantees. You understand that outcomes vary and that any information provided may be incomplete, may change over time, or may not apply to your specific circumstances. ●Talk to your doctor. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition, symptoms, medications, supplements, diet changes, pregnancy, or treatment decisions. Never disregard professional medical advice or delay seeking it because of information you received through our Services. ●Emergency. If you believe you may have a medical emergency, call 911 (or your local emergency number) immediately. Drug testing services and results are provided for screening/informational and/or administrative purposes as applicable and are not medical diagnosis or treatment. By using our Services, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. ●Informed Consent: For all DNA and drug testing services, the individual being tested (or their legal guardian) must provide explicit, written informed consent at the time of the service. ●Minors: Testing involving minors requires the signature and consent of a legal parent or guardian. We offer two distinct types of Paternity DNA testing: ●Non-Legal (Peace of Mind): These tests are for personal knowledge only. Because the identity of the participants is not verified by a neutral third party and a strict chain of custody is not maintained, these results are not admissible in a court of law and may not be accepted by courts, government agencies, or other third parties. ●Legal (Chain of Custody): These tests are conducted following strict legal protocols, including identity verification and documented chain-of-custody procedures. These results are intended for use in legal matters such as child support, custody, immigration, or other proceedings, and are generally suitable for submission to a court or agency when collected and processed in accordance with the required legal/chain-of-custody procedures. You are responsible for selecting the correct test type. If you need results for any court, agency, or official purpose, you must book a Legal (Chain of Custody) test. If you book a non-legal test and later decide you need legal results, you will need to purchase and complete a separate legal test. ●Booking: Appointments must be scheduled through our website or via our official contact channels. You agree to provide accurate contact information, service address (for mobile appointments), and participant details as requested. ●Arrival and Identification: For Legal (Chain of Custody) testing, each participant must present valid government-issued photo identification (or other documentation as required by the applicable chain-of-custody protocol). If required identification is not provided, we may be unable to complete the service and it will be treated as a late cancellation/no-show. ●Mobile Service Fees: Mobile phlebotomy and testing services may be subject to a travel fee based on the location of the service, timing, and availability. Travel fees (and any deposits) are disclosed at booking. ●Site Requirements (Mobile): You are responsible for providing a safe, clean, and appropriate area for specimen collection, with reasonable privacy. We may refuse or stop services if conditions are unsafe, unsanitary, or otherwise inappropriate (including threats, harassment, or unsafe animals on site). In such cases, the appointment may be treated as a late cancellation/no-show. ●Collection Protocols: You agree to follow our collection instructions. Improper collection conditions, participant non-cooperation, or failure to follow instructions may result in an invalid sample or delayed results, and may require recollection at your expense. ●Rescheduling/Cancellations: We require at least 24 hours' notice for cancellations or rescheduling. Failure to provide sufficient notice, inability to access the service location, or "no-shows" for mobile appointments may result in a cancellation fee and/or forfeiture of your deposit. ●Pricing: Prices for all services are listed on our website and are subject to change. ●Payment: Payment is due at the time of booking or at the time of service, as specified during the checkout process. We accept major credit cards and other electronic payment methods. ●Deposits and Mobile Fees: Certain Services (including mobile appointments) may require a deposit and/or include travel or convenience fees. Unless we state otherwise in writing, travel fees are non-refundable once the appointment is confirmed and time is reserved. ●Cancellations/Rescheduling: We require at least 24 hours' notice for cancellations or rescheduling. Late cancellations, inability to access the service location, or no-shows may result in a cancellation fee and/or forfeiture of amounts paid (including deposits and travel fees), as permitted by law. ●Refunds (General): Due to laboratory costs, third-party fees, and the personalized nature of DNA kits, wellness assessments, and specimen collection, refunds are generally not provided once (a) a sample has been collected, (b) a kit has been opened, used, or submitted, or (c) an order has been transmitted to or processing has begun with a laboratory. ●Limited Refund Situations: If you believe you were charged in error or you did not receive the Services due to our cancellation (and not due to unsafe conditions, inability to verify identity, refusal to consent, or other customer-caused issues), contact us promptly. If a refund is approved, it will be issued to the original payment method and may exclude non-refundable third-party or travel fees. While we partner with accredited laboratories to ensure the highest degree of accuracy, Black Diamond Wellness & DNA Services does not guarantee a specific outcome. Factors such as improper sample collection (if performed by the client) or rare biological variations may affect test results. Your privacy is our priority. We maintain strict confidentiality regarding your identity and test results. Our use of your personal and genetic information is governed by our Privacy Policy. By using our Services, you consent to the collection and use of data as outlined in that policy. To the maximum extent permitted by law, Black Diamond Wellness & DNA Services, its owners, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Services or the reliance on any test results. Our total liability to you for any claim shall not exceed the amount paid by you for the specific service in question. You agree to indemnify and hold harmless Black Diamond Wellness & DNA Services from any claims, losses, or damages (including legal fees) resulting from your violation of these Terms, your provision of false information (including identity), or your unauthorized use of the test results. These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in El Paso County, Texas. We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.
